2. Scope and acceptance
These terms govern access to the website patriciasofia.com and the booking of the services presented on it: Homeopathy and Traditional Chinese Medicine consultations and treatments, in person and remotely, and the digital content made available.
A consultation or treatment booking is only completed once you expressly accept these terms, including the cancellation and rescheduling rules in section 6 and the duties of disclosure in section 7. Your acceptance is recorded with the booking, and the version that applies is the one published on this page at that time.
3. Nature of the services
Consultations and treatments fall within the field of non-conventional therapies, whose professional practice is governed by Portuguese Law no. 71/2013 of 2 September, which implements Portuguese Law no. 45/2003 of 22 August. The practitioner in charge holds professional licence no. C-61967 in Traditional Chinese Medicine, issued by the Central Administration of the Health System.
They are not a substitute for conventional medical care, medical diagnosis or prescribed medication. Nothing on the website, in the content or in the consultations should be understood as a promise of cure or as a recommendation to discontinue treatment prescribed by another health professional. In an emergency, call SNS 24 (808 24 24 24) or 112.
4. Booking and confirmation
Bookings are made through the online booking system, by telephone, or through the messaging channels listed on the website.
Consultations take place in person, at the practice locations listed in section 1, or remotely, by the means stated in the booking confirmation, according to the option chosen.
For online bookings of paid services, the booking is only confirmed once payment is completed within the time limit shown by the booking system at the time of booking, currently 20 minutes. If payment is not completed within that period, the booking is cancelled automatically, the slot is released, and you may book again subject to availability.
For free services, and for bookings made by telephone or through the messaging channels, the booking is confirmed once Patrícia Sofia Homeopatia confirms it.
Confirmation is sent by email to the address given at booking.
The first response in the messaging channels is automated and identified as such. You may ask to speak to a person at any time.
5. Prices, payment and invoicing
The applicable prices are those shown in the booking system at the time of booking, in euros, inclusive of any taxes due.
For online bookings, payment is processed by Stripe through the booking system, by bank card or MB WAY. In person, payment is accepted in cash or by bank card, also processed by Stripe. No other means of payment are accepted.
The invoice is issued by the booking system at the time of booking and sent to the email address provided.
The services are not reimbursed by any health subsystem or health insurer.
6. Cancellation, rescheduling and late arrival
This section applies to every booking, whatever the channel through which it was made, and is accepted at the time of booking.
Every booking reserves consultation time, space and materials that are set aside for you and unavailable to anyone else. That commitment of resources, which stands even when the consultation does not take place, is what the rules below reflect. They are the same for everyone and are known before you book.
- Rescheduling more than 24 hours in advance: free of charge, to any date and time that suits you, subject to availability.
- Cancellation more than 24 hours in advance: free of charge. Any amount paid is refunded in full.
- Cancellation or rescheduling less than 24 hours in advance: the full fee for the consultation is due and any amount already paid is not refunded.
- No-show without notice: the full fee for the consultation is due and any amount already paid is not refunded.
- Late arrival: there is a 10-minute grace period. Beyond that, the consultation may be treated as a no-show.
Cancellations and rescheduling must be notified through the contacts in section 1 or through the means indicated in the confirmation message.
Reminders are sent by email and SMS 24 hours in advance, asking you to confirm attendance. The reminder is a courtesy: its absence changes neither the date and time of the confirmed booking nor anything set out in this section.
Patrícia Sofia Homeopatia may, on justified grounds, cancel or reschedule a consultation, giving as much notice as possible. Where no new date is agreed, any amount paid is refunded in full within 14 days, by the same means of payment, unless otherwise agreed.
7. Your duties
By booking, you undertake to give truthful and complete information about your state of health, symptoms, medical history, the medication and supplements you take, any treatment you are following and, where applicable, pregnancy or breastfeeding, and to report any relevant change before the consultation.
This information is the basis of the work done in consultation and of safe follow-up. Information withheld or inaccurate undermines the outcome and may make it inadvisable to continue.
You also undertake to attend at the time booked and, for remote consultations, to ensure minimum conditions of privacy and connection.
Health data is processed in accordance with the Privacy Policy, with your explicit consent and under professional secrecy.
8. Distance contracts
Consultations and treatments are healthcare services and are therefore excluded from the regime governing distance and off-premises contracts, under Article 2(2)(f) of Portuguese Decree-Law no. 24/2014 of 14 February. The 14-day right of withdrawal set out in that regime does not apply to them.
Cancellation and rescheduling of consultations and treatments are governed by section 6.
The digital content made available on the website is free of charge and obtaining it involves no payment. Should paid digital content be offered in future, the statutory rules on distance contracts will apply to it, including the right of withdrawal and its exceptions, which will be set out at the time of purchase.
9. Free digital content
Guides, masterclasses and other free materials are for personal use. They may not be resold or redistributed. They are informational in nature and do not constitute individual clinical advice.
10. Intellectual property
All rights in the texts, images, videos, trade marks and materials on the website are reserved, whether they belong to Patrícia Sofia Homeopatia or to third parties whose content is used under licence or authorisation. None of these elements may be copied, reproduced or reused without the written permission of the rights holder.
11. Personal data
See the Privacy Policy, which forms an integral part of these terms, at www.patriciasofia.com/en/privacy-policy.
12. Complaints and dispute resolution
You may file a complaint in the Portuguese electronic Complaints Book at www.livroreclamacoes.pt, or write to servicos@patriciasofia.com.
For consumer disputes, you may refer the matter to an alternative dispute resolution body. For contracts concluded and performed in the Lisbon Metropolitan Area, where both practice locations are situated, the competent body is the Lisbon Consumer Disputes Arbitration Centre(Centro de Arbitragem de Conflitos de Consumo de Lisboa), at www.centroarbitragemlisboa.pt, whose jurisdiction covers disputes up to 5,000 euros. This information is provided under Portuguese Law no. 144/2015 of 8 September.
13. Governing law and jurisdiction
Portuguese law applies.
Disputes not settled by agreement are subject to the statutory rules on the jurisdiction of the courts, which these terms do not set aside, without prejudice to the alternative dispute resolution referred to in section 12.
14. Changes
These terms may be amended. The version applicable to each booking is the one published on this page at the time the booking is made, with the effective date shown at the top.
